When is the Tenant Protection Plan Required?
A TPP is required for any construction, alteration, or partial demolition in an occupied building, even if the work is in a commercial space within a mixed-use building. Each permit application requires a separate TPP tailored to the project.
Do Co-ops and Condos Need a TPP?
Yes. Even though unit owners are not traditional tenants, a TPP is required if any units are occupied during construction.
Who Prepares and Files the TPP?
The contractor or owner must hire a Registered Architect or Professional Engineer to take responsibility for TPP Special Inspection requirements and prepare and submit the TPP narrative for DOB approval.

What are the posting requirements for TPP’s?
– Contractors or Building owners must:
• Distribute a TPP Notice to tenants.
• Post the TPP Notice in the lobby and on each floor near the elevator/stairs.
• Provide a paper copy of the narrative upon request.
• Notify the DOB at least 72 hours before starting work.
• Display the Safe Construction Bill of Rights on every floor.

Who performs periodic checks to ensure compliance with the TPP Narrative?
Inspections are required to be performed by the Special Inspection Agency responsible for Tenant Protection Plan TR1:
• Before the start of Construction and/or Demolition to document conditions.
• At the start of Construction and/or Demolition
• Weekly during Construction/Demolition.
• After a TPP violation is issued to, confirm corrections.
• If construction moves to another area or construction operations change.
Who is Responsible for Special Inspections?
• The building owner or contractor must hire an independent special inspector.
• Hazardous conditions must be reported to the DOB immediately via 311.
• Inspections are not required for work inside owner-occupied units without service disruptions.
What are the consequences for failure to comply with TPP laws?
Failure to comply can lead to fines and violations:
• No TPP Filed: $10,000 (first offense), up to $25,000 (second offense).
• Inadequate TPP: $1,600 fine and possible audit.
• Failure to Post Notices: $1,250 per violation.
• Failure to Notify DOB Before Work: $1,250 fine.
• Stop Work Order if conditions are unsafe.
• Is a TPP required for a one family home?
No.
• Can a TPP be waived?
No, not if other units are occupied.
• Do all filings need separate TPPs?
Yes, all initial and subsequent filings are required to file a TPP
• Is a TPP needed for non-residential buildings?
